FlexiWork website terms of service

DBCB and its FlexiWork brand (together, “FlexiWork”, “we”, “us”, or “our”) own and operate the website and related digital properties through which FlexiWork products and services are marketed (the “Site”). These Website Terms and Conditions (the “Website Terms”) describe the rights and obligations of an unregistered website user or visitor (“user” or “you”) in connection with your use of the Site.

By accessing or using the Site in any way, including as an unregistered website visitor, you agree to be bound by these Website Terms and our Privacy Policy.

These Website Terms apply to your use of the Site and the content made available on or through the Site. If you use or access any of our physical workspace, restricted-access member portals (i.e. those requiring a login), booking or payment flows, referral programmes, or other services we provide, your use of such space, services or programmes is also subject to the membership agreement, booking confirmation, invoice, or other terms you received or accepted when you signed up. If you book or avail any products or services through our partners or other service providers, you will also be subject to the terms of those providers.

From time to time, we may make modifications, deletions or additions to the Site or these Website Terms. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.

The Site and the services it describes are available only to individuals who are at least 18 years old, unless we specify otherwise. No one under this age may access or use the Site or provide any personal information through the Site.

Where you book on behalf of a company or other entity, you represent that you are authorised to bind that entity to these Website Terms and any applicable membership or booking terms.

The text, images, videos, audio clips, software, trademarks, logos and other content generated, provided, or otherwise made accessible on or through the Site (collectively, “Content”) are contributed by us, DBCB, and our licensors. The Content and the Site are protected by the laws of India and applicable international intellectual property laws.

We and our licensors retain all proprietary rights in the Site and the Content. Except as expressly set forth in these Website Terms, no rights are granted to any Content. Subject to these Website Terms, we grant each user of the Site a worldwide, non-exclusive, non-sublicensable and non-transferable licence to use (i.e., to download and display locally) Content solely for viewing, browsing and using the functionality of the Site.

All Content is for general informational purposes only. It does not constitute an offer, advice, or a commitment to provide workspace until a booking or membership is confirmed in writing (including electronic confirmation). We reserve the right, but do not have any obligation, to monitor, remove, edit or modify any Content, in our sole discretion, at any time for any reason or for no reason at all.

Unless a specific product page, invoice or membership agreement states otherwise, payments made through the Site for FlexiWork products and services are irrevocable, non-refundable and non-creditable once charged, except where required by applicable law.

We may require completion of Know Your Customer (KYC) checks and identity verification before providing services. We are not obligated to provide services, and you are not entitled to receive services, until KYC (where required) is completed to our satisfaction. If you fail to complete KYC within the timeframe we specify, we may cancel your request without obligation to refund payments already made, and no services will be provided until KYC is completed.

Day passes & on-demand bookings

We do not offer cancellations for on-demand day passes, day-pass bundles, or similar drop-in products booked through the Site. Where the product flow allows, you may reschedule from your account or confirmation link before the start time. Please review all details carefully before confirming your booking.

Meeting rooms & events

We do not offer cancellations for meeting rooms or events booked through the Site, unless a specific confirmation email states a different cancellation window. Please ensure all details are reviewed carefully before confirming your booking.

Long-term leasing & private offices

Private offices, dedicated desks and other longer-term arrangements are governed by the membership agreement or lease terms issued at signup. Early termination, notice periods, deposits and any refunds (if any) are as set out in that agreement, not these Website Terms.

To the extent permitted by law, FlexiWork, DBCB, and each of their affiliates, parents and successors, and each of their employees, assignees, officers, agents and directors (collectively, the “FlexiWork Parties”) disclaim all warranties and terms, express or implied, with respect to the Site, Content or services (including third-party services) on or accessible through the Site, including any warranties or terms of merchantability, fitness for a particular purpose, title, non-infringement, and any implied warranties arising from course of dealing, course of performance or usage in trade.

The FlexiWork Parties disclaim all liability to the maximum extent permitted by law for claims, damages, expenses or any other losses arising out of or in connection with products or services availed through our partners, service providers, or any other third party.

In no event shall the FlexiWork Parties be liable under contract, tort, strict liability, negligence or any other legal or equitable theory with respect to the Site for (a) any special, indirect, incidental, punitive, compensatory or consequential damages of any kind whatsoever (however arising), or (b) damages in excess of (in the aggregate) INR 10,000.

These Website Terms shall be governed by and construed in accordance with the laws of India, without regard to conflicts of law principles. Subject to applicable law, courts in New Delhi shall have exclusive jurisdiction over disputes arising from these Website Terms.

These Website Terms constitute the entire agreement between us regarding the Site and supersede and merge any prior proposals, understandings and contemporaneous communications relating to the Site. If any provision is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these Website Terms otherwise remain in full force and effect. Any waiver must be in writing from us. Failure to enforce any right is not a waiver of that right.
